1. Beta version terms of use

Text version: beta-2026-09. Effective date: 20 September 2026.

1. Purpose and nature of the service

1.1. These terms govern access to and use of the Beta version of the EnrolaMar platform, whose owner acts as a sole trader.

1.2. EnrolaMar is a tool supporting documentary and administrative management of maritime crew enrolment. Its function is to organise, remind and pre-fill information from the documents users provide. EnrolaMar is not an administrative authority, does not certify the validity of any document, and provides no legal, employment or medical advice.

1.3. The Beta version is a pre-production version intended for testing with real users. It may be incomplete, contain errors, return inaccurate results, and change substantially before general release.

2. Acceptance of these terms

2.1. Use of the Beta version requires express acceptance of these terms through the affirmative action provided for that purpose. EnrolaMar will keep a record of the date, time and version of the text accepted.

2.2. If EnrolaMar substantially amends these terms, it will request fresh acceptance before allowing continued use of the platform. Merely continuing to use the service does not amount to acceptance of a new version.

3. No warranty of availability or of result

3.1. During the Beta, the platform is provided as is and as available. No service level agreement applies, and there is no commitment as to uptime, response time or support.

3.2. EnrolaMar may interrupt, suspend, modify or withdraw features at any time, with or without prior notice, for technical or security reasons or as the product evolves.

3.3. Automatic document reading (OCR) is an automated process subject to error. The extracted data, including expiry dates, document numbers and issuing bodies, must be checked by the user before being relied upon.

4. Data and backups

4.1. Although EnrolaMar applies reasonable technical and organisational measures, during the Beta data and documents may be lost, altered or temporarily unavailable.

4.2. The user must keep the original or their own copy of every document uploaded to the platform. EnrolaMar is not an official archive and does not replace the document custody that legally falls to the user or the shipowner.

5. The information shown does not replace official verification

5.1. The legal traffic light, expiry alerts, minimum-manning indicators and any other indicator on the platform are informative aids calculated from the data available in EnrolaMar. They do not certify that the documentation is valid, nor that the vessel or the crew member complies with the applicable rules.

5.2. Forms, lists and documents generated by EnrolaMar are preparatory in nature. They have no official validity until submitted to and accepted by the competent body, and they do not exempt anyone from clearance, crew registration or any other procedure before the Harbour Master (Capitanía Marítima), the Instituto Social de la Marina, the Directorate-General of the Merchant Navy or any other authority.

5.3. Checking that certificates are in force and carrying out the official procedures is in all cases the responsibility of the user and, where applicable, of the shipowner as employer and of the skipper when making the responsible declaration prior to clearance.

6. User obligations

6.1. The user warrants that the data and documents they provide are true and up to date, and that they are entitled to provide them. Where a shipowner records a crew member's documentation, it declares that it has their authorisation.

6.2. The user undertakes to report to EnrolaMar any error or incident they detect, so that it can be corrected during the testing phase.

6.3. The user shall not use the platform for purposes other than those intended, nor attempt to access third-party data they are not entitled to.

7. Liability

7.1. EnrolaMar is liable for damage it causes through wilful misconduct, gross negligence or breach of the essential obligations assumed under these terms, as well as for personal injury. Nothing in this document excludes or limits liability that cannot lawfully be excluded or limited; in particular, and under article 1102 of the Civil Code, any advance waiver of the right to claim liability arising from wilful misconduct is void.

7.2. As against business users, and to the extent permitted by law, EnrolaMar's total aggregate liability during the Beta phase is limited to the amount actually paid by the user in the twelve months preceding the triggering event or, where the service was provided free of charge, to five hundred euros. Loss of profit and indirect damage are excluded.

7.3. The limitations in clause 7.2 do not apply to users who qualify as consumers under Royal Legislative Decree 1/2007, who retain in full the rights that law affords them, including those laid down for contracts for the supply of digital content or services.

7.4. EnrolaMar is not liable for decisions on embarkation, hiring, clearance or inspection taken by third parties on the basis of the information shown on the platform.

8. Data protection

8.1. EnrolaMar processes personal data, including health data contained in medical fitness certificates for embarkation, which constitute a special category under article 9 of Regulation (EU) 2016/679.

8.2. EnrolaMar acts as controller in respect of user accounts and the crew member's document wallet, and as processor when it processes crew documentation on behalf of a shipowner, on the terms of the corresponding processing agreement entered into under article 28 of the Regulation.

8.3. Full information on purposes, legal bases, recipients, processors, retention periods, international transfers and how to exercise your rights is set out in section 2 of this page. Users may lodge a complaint with the Spanish Data Protection Agency (www.aepd.es).

8.4. Consent to the processing of health data and consent to share the document wallet with a shipowner are collected separately from acceptance of these terms, and may be withdrawn at any time without affecting the lawfulness of prior processing.

9. Free access and prices

9.1. During the Beta phase, access is free for crew members and will remain so after general release, under the Maritime Labour Convention, 2006.

9.2. The commercial terms applying to shipowners during the Beta are those communicated to each of them individually. Prices for the general version of the service are subject to change; no commercial term of the Beta creates any right to its continuation afterwards.

10. Duration and termination

10.1. The Beta phase runs for an indefinite period and may end at any time at EnrolaMar's decision, which will be notified with reasonable notice and, in any event, at least fifteen calendar days in advance.

10.2. The user may leave the Beta at any time, free of charge and without having to give reasons, by requesting deletion of their account from the platform settings.

10.3. When the Beta ends, EnrolaMar will allow the user to download their data and documents for a minimum of thirty calendar days, after which it will delete them unless legally required to retain them.

11. Feedback and confidentiality

11.1. Suggestions, bug reports and comments provided by the user may be used freely by EnrolaMar to improve the product, without consideration and without granting the user any right over the platform.

11.2. The user shall refrain from publicly disclosing unreleased features accessed during the Beta.

12. Governing law and jurisdiction

12.1. These terms are governed by Spanish law.

12.2. For users who qualify as consumers, the courts of their place of residence shall have jurisdiction, in accordance with consumer protection law. For all other users, the parties submit to the courts of Pontevedra, waiving any other jurisdiction that might apply.

12.3. This text is also published translated into Galician and English to aid understanding. In the event of any discrepancy between versions, the Spanish version prevails.

2. Privacy policy

Information provided under articles 13 and 14 of Regulation (EU) 2016/679 (GDPR) and Organic Act 3/2018 (LOPDGDD).

3.1. Data controller

The controller is the owner of EnrolaMar, contact address pablo@enrolamar.com. Data Protection Officer: [PENDING APPOINTMENT].

3.2. What data we process and why

Account and authentication data (name, email address, hashed password, language, user type), to create and maintain your access to the platform.

Crew member professional profile (STCW certificate, navigation areas, availability, days at sea, description), so you can present yourself to shipowners and so we can calculate how well you match enrolment offers.

Maritime documentation (national ID or passport, seafarer's record book, ISM medical fitness certificate, STCW certificates and professional certificate of competency), including the data automatically extracted from them by OCR: number, issuing body and expiry date. These build your document wallet, calculate the legal traffic light and warn you before anything expires.

Vessel and enrolment data (vessel, rank on board, dates, days at sea), to prepare procedures before the Harbour Master and maintain your digital seafarer's record book.

Billing and subscription data of shipowners.

Technical logs of document access (who consulted what and when), as a security and traceability safeguard.

3.3. Legal basis

Performance of the contract (art. 6(1)(b) GDPR) for the account, the profile, the document wallet and billing.

Compliance with a legal obligation (art. 6(1)(c) GDPR) for enrolment and clearance procedures, in connection with the applicable maritime rules.

Legitimate interest (art. 6(1)(f) GDPR) for platform security, fraud prevention and access logging.

Consent (art. 6(1)(a) GDPR) to share your document wallet with a specific shipowner, and explicit consent (art. 9(2)(a) GDPR) for processing the medical certificate. Both are separate, specific and may be withdrawn at any time. [ARTICLE 9 BASIS PENDING CONFIRMATION BY DPO.]

3.4. Health data

The medical fitness certificate for embarkation, governed by Royal Decree 505/2024, may carry the findings fit, fit with restrictions, or unfit. As it reveals information about your state of health, we treat it as a special category under article 9 GDPR, with reinforced safeguards: it is stored encrypted, access is logged, and it is never disclosed to the shipowner, who only sees whether the document is in force, never its content.

3.5. Recipients

The Harbour Master and other competent authorities, where the procedure requires it.

Shipowners with whom you have established an accepted connection, and only to the extent that connection allows.

Processors needed to provide the service: hosting, file storage, email, optical character recognition, AI assistant and payment gateway. All of them under a processing agreement in accordance with article 28 GDPR.

We do not sell or transfer personal data to third parties for commercial purposes.

3.6. International transfers

[PENDING.] Any processor handling data outside the European Economic Area and the applicable transfer mechanism will be declared here. Documents containing health data will be kept within the European Union.

3.7. Retention periods

Account data and data associated with it are kept while the account is active and are deleted when it is closed. Documents rejected at verification are deleted automatically after one year. Remaining periods by category: [PENDING DEFINITION].

3.8. Your rights

You may exercise the rights of access, rectification, erasure, restriction of processing, portability and objection, and withdraw at any time the consents you have given. Exporting your data in JSON format is available directly from your account settings, as is full deletion.

For anything else, write to pablo@enrolamar.com. If you believe we have not handled your request properly, you may complain to the Spanish Data Protection Agency (www.aepd.es).

3.9. Minors

The service is aimed at seafaring professionals of legal age. We do not knowingly collect data from minors.

3.10. Automated decisions

The legal traffic light classifies the state of your documentation as green, amber or red based on the recorded expiry dates. It is an informative indicator: on its own it produces no legal effects and no automated decisions about your hiring, which always rest with a person. You may request its review and the rectification of any data it depends on.
